Terms of Purchase – Silo Service Sweden AB

These terms apply to all services and goods provided by Silo Service Sweden AB. By engaging our services or ordering goods, you accept these terms.

1. Scope of Application

These terms of purchase apply between Silo Service Sweden AB (hereinafter 'Silo Service') and the customer for the purchase of services such as silo cleaning, process cleaning, blasting, painting, installation, silo inspection, fall protection services and on-call work, as well as for the purchase of goods such as spare parts, filters and equipment. These terms apply unless otherwise agreed in writing.

2. Quotation and Order

A quotation from Silo Service is valid for 30 days from the date of issue unless otherwise stated. An order is binding when the customer has confirmed the quotation in writing or verbally, or when Silo Service has confirmed an order in writing. Silo Service reserves the right to decline orders.

3. Prices and Payment

All prices are stated exclusive of VAT unless otherwise stated. Payment is made by invoice with a 30-day payment term unless otherwise agreed. Silo Service reserves the right to adjust prices in the event of material changes in material or resource costs.

4. Performance of Services

Silo Service performs all services in a professional manner and in accordance with applicable safety regulations. The customer is responsible for granting Silo Service access to the facility and for ensuring the facility is in a condition that allows safe working. Any deviations from the ordered work due to on-site conditions will be communicated to the customer and may affect price and schedule.

  • The customer is responsible for ensuring the facility can be emptied and is accessible at the agreed time.
  • The customer is responsible for informing Silo Service of any risks or hazardous materials present at the facility.
  • Silo Service is not liable for downtime or production losses arising from planned works.

5. Goods and Spare Parts

Goods sold by Silo Service are delivered in accordance with what is stated in the order confirmation. Delivery times are approximate. Ownership of the goods passes to the customer only upon full payment. We offer a 1-year warranty on goods against material and manufacturing defects under normal use. The warranty does not cover:

  • Damage caused by incorrect installation, use or maintenance.
  • Normal wear and tear.
  • Damage caused by external factors such as accidents or natural events.

6. Complaints

In the event of a defect in a service performed or goods delivered, the customer must lodge a complaint within a reasonable time from when the defect was discovered or ought to have been discovered. Complaints must be submitted in writing to Silo Service with a description of the defect and supporting documentation. Silo Service undertakes to primarily remedy the defect or carry out redelivery. Consumer customers are entitled to make a complaint within three years of delivery in accordance with the Consumer Sales Act.

When making a complaint, please state:

  • Order number or assignment number.
  • Description of the defect.
  • Photos or other documentation.

7. Liability and Limitation of Liability

Silo Service is not liable for indirect damage, loss of profit, production losses or any other consequential damage arising from a defect in a service or goods. Silo Service's total liability towards the customer is limited to the amount paid by the customer for the relevant assignment. Silo Service holds liability insurance for its operations.

8. Force Majeure

Silo Service is exempt from liability for delays or failure to fulfil its obligations if this is due to circumstances beyond Silo Service's control, such as strikes, lockouts, fire, natural disasters, war, pandemic, governmental decisions or similar events. Silo Service shall notify the customer without delay if a force majeure situation arises.

Silo Service Sweden AB reserves the right to update these terms of purchase. The current terms are always published on this page. Governing law: Swedish law. Disputes shall be resolved primarily through negotiation, and secondarily by a court of general jurisdiction with Malmö tingsrätt as the court of first instance.
